This website is owned and operated by Nexus Bev (“Nexus Bev”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the nexusbev.org website (the “Site”) and its associated application portal (the “Services”).

Nexus Bev operates a beverage business incubator (the “Program”). Our Services allow you to learn about our Program and to submit an application for consideration. This includes creating a user account, filling out an application form, and uploading related documents.

2. User Accounts

To access the application portal, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Promptly notify us if you discover or otherwise suspect any security breaches related to the Services.

We reserve the right to suspend or terminate your account at any time for any reason, including for violation of these Terms.

3. User Conduct

You agree that you will not:

• Use the Services for any illegal or unauthorized purpose.
• Attempt to compromise the security of the Services, including by uploading malicious files or attempting to access data not intended for you.
• Submit information that is false, misleading, or infringes on the rights of others.

4. Intellectual Property

• Our Intellectual Property: The Site, its content, branding, and overall look and feel are the exclusive property of Nexus Bev and its licensors.
• Your Intellectual Property: We claim no ownership rights over the content you submit as part of your application (your answers, CV, pitch deck, etc.). You retain all ownership of your intellectual property. By submitting an application, you grant Nexus Bev a limited, non-exclusive, worldwide, royalty-free license to review, analyze, and share your application materials with our internal selection committee and trusted partners for the sole purpose of evaluating your candidacy for the Program.

5. Disclaimers

The Services are provided “as is” without warranty of any kind. We do not guarantee that your application will be reviewed or that you will be accepted into the Program. We are not responsible for any technical malfunctions or other problems that may result in the loss of your application data. We strongly recommend you keep a backup of all submitted materials.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Nexus Bev shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your access to or use of the Services.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law principles.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Services after any such change constitutes your acceptance of the new Terms.
